Packaging Units

Unless otherwise stated, all bottles contain 0.75 litres. Most wine cartons contain 12/1 bottles; sparkling wine and Champagne cartons usually contain 6/1 bottles.

Prices

All prices are ex-warehouse and refer to individual bottle prices (gross). Prices include the statutory rate of VAT (for business customers: net unit prices plus statutory VAT), which is shown separately on the invoice. The prices applicable at the time of your order shall apply. All previously quoted prices are therefore invalid. The validity period of our limited-time offers can be found wherever these are displayed in the shop. Despite careful stock management, it may occur that a promotional item sells out more quickly than anticipated. We therefore cannot guarantee delivery. Offer valid while stocks last.

The prices quoted by us do not include any import duties applicable in the country of destination. For deliveries to countries outside the European Union (third countries), additional costs may arise; details are governed by the section “Deliveries to Countries Outside the EU (Third Countries)”.

Formation of Contract and Storage of Contract Text

The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding online catalogue. Sales and dispatch are handled by Taits UG (haftungsbeschränkt). You may add items to your virtual shopping basket by clicking the “Order” or “Add to basket” buttons. Prior to placing your order, you will be given the opportunity on a displayed page to identify and correct any input errors before submitting your contractual declaration. Please review your order carefully.
By clicking the “Buy” button, you submit a binding offer to conclude a purchase contract for the goods contained in your shopping basket. You have the option to save or print your order after it has been placed. Confirmation of receipt of your order follows immediately upon submission and does not yet constitute acceptance of the contract. We shall declare our acceptance of the contract expressly, or by dispatching the goods, or by requesting payment — whichever occurs first — by the end of the fourth working day following the order. Should we offer you the option to pay for the order in advance, this shall constitute our binding offer to conclude a purchase contract with the selected payment method, which you may accept by making payment, whereby the contract is formed upon your payment.
We store the contract text and will send you the order details and our terms and conditions by e-mail. The terms and conditions can also be viewed here at any time. For security reasons, your order data are no longer accessible via the internet. A contract may be concluded in the German language.
Should we determine after conclusion of the contract that we are permanently unable to deliver ordered goods through no fault of our own (e.g. due to force majeure or non-delivery despite timely reordering), we shall be entitled to withdraw from the contract. In such a case, we will notify you without delay and refund any payments already made.

Child Protection Act

In accordance with the Youth Protection Act, we only deliver alcoholic beverages to persons aged 18 years or over. Our packaging is marked with a prominent coloured label indicating that no handover to persons under 18 years of age will take place. Furthermore, delivery personnel are required, in the event of the slightest doubt, to verify the recipient’s identity and legal age by requesting proof of identification, and to hand over the goods only to persons of legal age.

Delivery Date

Unless you specify a particular delivery date, goods will be delivered within 3–4 working days of placing your order. For deliveries to countries outside the European Union, the delivery time may be extended due to customs clearance.

Deliveries to Countries Outside the EU (Third Countries)

For deliveries to countries outside the European Union (e.g. the United Kingdom, Switzerland, Norway, and other third countries), shipment is made without customs clearance and without payment of taxes. The prices quoted by us do not include any import duties applicable in the country of destination.

Additional costs may arise upon importation, in particular customs duties, import VAT or the applicable sales tax in the country of destination, excise duties (e.g. on alcohol), as well as handling, customs clearance, or disbursement fees charged by the transport service provider. These charges and fees are to be borne by the recipient and are generally collected directly from the recipient by the transport service provider or the customs authority. Their amount is determined by the law of the country of destination. Please enquire with the relevant customs authorities about the likely costs before placing your order.

The recipient is also responsible for ensuring that the importation of the ordered goods is permitted in the country of destination (e.g. import or quantity restrictions, licensing or registration requirements for alcoholic beverages, age limits).

Refusal of Acceptance and Unpaid Import Duties

Should the recipient refuse to accept the shipment, or should import duties or charges due in the country of destination remain unpaid, resulting in the shipment being returned to us, placed into storage, or destroyed by the carrier, the following shall apply:

Where no valid right of withdrawal has been exercised, we are entitled to claim from the customer the costs actually incurred by us as a result – in particular the original shipping costs as well as any return, storage, and disposal costs charged by the carrier – or to offset these against any claim for reimbursement. In such cases, the refund shall consist of the value of the goods less the aforementioned costs actually incurred.

In relation to business customers, this shall also apply where delivery could not be completed for reasons within their responsibility.

The statutory rights of consumers in the event of a valid withdrawal remain unaffected; in this regard, the provisions of the cancellation policy set out below shall apply.

Online Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR platform), which you can access via this link. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration body.

CANCELLATION POLICY

Right of Cancellation
You have the right to cancel this contract within 4 weeks without giving any reason. The cancellation period is 4 weeks from the day on which you, or a third party designated by you who is not the carrier, took possession of the last goods.

To exercise your right of cancellation, you must notify us:

by means of a clear declaration (e.g. a letter sent by post or an e-mail) of your decision to cancel this contract.

You may use the model cancellation form for this purpose, though it is not required.

To meet the cancellation deadline, it is sufficient for you to send your notification of exercising the right of cancellation before the cancellation period has expired.

Consequences of Cancellation
If you cancel this contract, we shall reimburse all payments received from you, including delivery costs (with the exception of any additional costs arising from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we received notification of your cancellation of this contract. We will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees as a result of this reimbursement.

Import duties incurred in the country of destination (e.g. customs duties, import VAT, excise duties) as well as charges levied by the carrier do not constitute payments received by us. We are therefore unable to refund such amounts paid to third parties (customs authorities, carriers).

For deliveries within Germany and the European Union, we will collect the goods and bear the costs of returning them. For deliveries to countries outside the European Union, you shall bear the direct costs of returning the goods.

You shall only be liable for any diminished value of the goods if such diminished value is attributable to handling that was not necessary for the purpose of examining the nature, characteristics, and functioning of the goods.

END OF CANCELLATION POLICY

Payment

We accept payment by PayPal, credit card (via Stripe), and bank transfer in advance. Upon request, we can also arrange cash payment upon collection in Berlin (by prior arrangement only).

You will receive an invoice from us. The invoice will be sent to you by e-mail once your order has been processed. In the interest of the environment, we do not issue printed invoices.

All prices include the applicable statutory VAT. Prices valid at the time of ordering shall apply. The delivered goods remain our property until payment has been received in full.

Warranty

The statutory warranty rights shall apply.
